Plateforme de résidences d'artistes – Jardin Musical

1. Objet

Les présentes Conditions Générales de Vente (ci-après « CGV ») ont pour objet de définir les conditions dans lesquelles la plateforme du Jardin Musical (ci-après « la Plateforme ») permet aux utilisateurs professionnels ou particuliers (ci-après « l'Utilisateur » ou « l'Artiste ») :

de créer un compte personnel
d'intégrer l'écosystème de résidence artistique du Jardin Musical
d'acheter des crédits
de réserver des créneaux d'occupation du studio
de réserver des services associés (ingénieur du son et/ou vidéo, accord de piano, nuitée, concert privé, etc.)

3. Accès à la Plateforme

L'accès à la Plateforme est réservé aux personnes :

majeures
disposant de la capacité juridique
ayant créé un compte utilisateur valide
ayant adhéré sans réserves aux CGU et aux présentes CGV

Le Jardin Musical se réserve le droit de refuser ou suspendre l'accès à tout compte en cas de non-respect des CGU et des présentes CGV.

4. Création de compte

La création d'un compte est obligatoire pour accéder aux services. L'Utilisateur s'engage à :

fournir des informations exactes et à jour
conserver la confidentialité de ses identifiants
assumer l'entière responsabilité des actions effectuées depuis son compte

5. Description des services

La Plateforme permet notamment :

la réservation de créneaux d'occupation du studio du Jardin Musical
la réservation de services techniques (ingénieur son, ingénieur vidéo)
la réservation d'un accord de piano
la réservation d'une nuitée au Jardin Musical
la réservation d'un créneau pour concert ou événement privé
l'accès à des formations à l'autonomie audiovisuelle
la gestion de crédits et d'historiques de réservation

Les services sont fournis selon les disponibilités affichées dans l'agenda.

6. Système de crédits

6.1 Principe

Les services proposés sur la Plateforme sont accessibles via un système de crédits achetés à l'avance. Chaque service correspond à un nombre défini de crédits, affiché sur la Plateforme.

6.2 Achat de crédits

Les crédits sont achetés via la Plateforme selon les tarifs en vigueur. Les paiements sont exigibles immédiatement. Les crédits sont crédités sur le compte utilisateur après validation du paiement.

6.3 Validité des crédits

Sauf mention contraire, les crédits sont :

non remboursables
non échangeables contre des espèces
valables pour une durée déterminée indiquée lors de l'achat

7. Réservations

7.1 Modalités

Les réservations se font exclusivement via la Plateforme, sous réserve de la disponibilité des créneaux et d'un solde de crédits suffisant. Toute réservation confirmée entraîne une consommation immédiate des crédits correspondants.

7.2 Modification et annulation

Les conditions de modification ou d'annulation sont précisées lors de la réservation. En cas d'annulation tardive ou de non-présentation, les crédits peuvent être perdus partiellement ou totalement, sauf cas de force majeure dûment justifié.

8. Obligations de l'Utilisateur

L'Utilisateur s'engage à :

respecter les lieux, le matériel et les équipements
utiliser le studio conformément aux règles communiquées
respecter les horaires réservés
assumer toute dégradation causée par lui-même ou ses collaborateurs

Des frais de réparation ou de remplacement pourront être facturés en cas de dommage.

9. Responsabilité

Le Jardin Musical ne saurait être tenu responsable :

des pertes de données personnelles de l'Utilisateur
de la qualité artistique ou commerciale des productions réalisées
des dommages résultant d'une mauvaise utilisation du matériel
des dommages sur le matériel causés par d'autres Utilisateurs
d'un empêchement lié à un cas de force majeure

10. Propriété intellectuelle

Les œuvres, enregistrements et contenus produits par l'Utilisateur dans le cadre de la résidence restent la propriété exclusive de l'Utilisateur, sauf accord écrit contraire. Le Jardin Musical ne revendique aucun droit d'exploitation sans consentement explicite.

11. Données personnelles

Les données personnelles sont traitées conformément au RGPD et à la Politique de confidentialité de la Plateforme. L'Utilisateur dispose d'un droit d'accès, de rectification et de suppression de ses données.

12. Suspension / résiliation

Le Jardin Musical se réserve le droit de :

suspendre ou résilier un compte en cas de violation grave des CGV
bloquer l'accès aux services sans indemnité en cas d'usage abusif

13. Modification des CGV

Les présentes CGV peuvent être modifiées à tout moment. La version applicable est celle en vigueur au moment de l'utilisation du service.

14. Droit applicable et juridiction compétente

Les présentes CGV sont soumises au droit belge. Tout litige relèvera de la compétence exclusive des tribunaux de Bruxelles, sauf disposition légale impérative contraire.

Algemene Verkoopvoorwaarden

1. Onderwerp

Deze Algemene Verkoopvoorwaarden (hierna "AV") hebben als doel de voorwaarden te bepalen waaronder het platform van Jardin Musical (hierna "het Platform") gebruikers (hierna "de Gebruiker" of "de Artiest") in staat stelt om:

een persoonlijk account aan te maken
in te stappen in het artistieke residentie-ecosysteem van Jardin Musical
credits te kopen
tijdslots in de studio te reserveren
aanvullende diensten te boeken (geluidstechnicus, videotechnicus, pianostemmer, overnachting, privéconcert, enz.)

2. Identiteit van de dienstverlener

Het Platform wordt uitgegeven door:

3. Toegang tot het Platform

Toegang tot het Platform is voorbehouden aan personen die:

meerderjarig zijn
rechtsbekwaam zijn
een geldig gebruikersaccount hebben aangemaakt
zonder voorbehoud hebben ingestemd met de Gebruiksvoorwaarden en deze AV

Jardin Musical behoudt zich het recht voor om toegang tot een account te weigeren of te schorsen bij niet-naleving van de Gebruiksvoorwaarden of deze AV.

4. Aanmaken van een account

Het aanmaken van een account is verplicht om toegang te krijgen tot de diensten. De Gebruiker verbindt zich ertoe:

correcte en actuele informatie te verstrekken
de vertrouwelijkheid van zijn inloggegevens te bewaren
de volledige verantwoordelijkheid te dragen voor acties uitgevoerd vanuit zijn account

5. Beschrijving van de diensten

Het Platform biedt onder meer:

reservering van tijdslots in de studio van Jardin Musical
reservering van technische diensten (geluidstechnicus, videotechnicus)
reservering van een pianoafstemming
reservering van een overnachting bij Jardin Musical
reservering van een tijdslot voor concert of privé-evenement
toegang tot opleidingen in audiovisuele autonomie
beheer van credits en reserveringsgeschiedenis

De diensten worden geleverd op basis van de beschikbaarheid die in de agenda wordt weergegeven.

6. Creditsysteem

6.1 Principe

De op het Platform aangeboden diensten zijn toegankelijk via een systeem van vooraf gekochte credits. Elke dienst komt overeen met een bepaald aantal credits, zoals weergegeven op het Platform.

6.2 Aankoop van credits

Credits worden via het Platform gekocht tegen de geldende tarieven. Betalingen zijn onmiddellijk verschuldigd. Credits worden na validatie van de betaling op het gebruikersaccount bijgeschreven.

6.3 Geldigheid van credits

Tenzij anders vermeld, zijn credits:

niet terugbetaalbaar
niet inwisselbaar voor contant geld
geldig voor een bepaalde duur die bij aankoop wordt vermeld

7. Reserveringen

7.1 Modaliteiten

Reserveringen worden uitsluitend via het Platform gedaan, onder voorbehoud van beschikbaarheid van tijdslots en een voldoend creditsaldo. Elke bevestigde reservering leidt tot onmiddellijk verbruik van de bijbehorende credits.

7.2 Wijziging en annulering

De voorwaarden voor wijziging of annulering worden bij de reservering vermeld. Bij laattijdige annulering of niet-aanwezigheid kunnen credits gedeeltelijk of volledig verloren gaan, behalve in geval van overmacht die naar behoren wordt gestaafd.

8. Verplichtingen van de Gebruiker

De Gebruiker verbindt zich ertoe:

de locatie, het materiaal en de uitrusting te respecteren
de studio te gebruiken overeenkomstig de meegedeelde regels
de gereserveerde tijdslots te respecteren
alle schade veroorzaakt door hemzelf of zijn medewerkers op zich te nemen

Herstel- of vervangingskosten kunnen worden aangerekend bij schade.

9. Aansprakelijkheid

Jardin Musical kan niet aansprakelijk worden gesteld voor:

verlies van persoonlijke gegevens van de Gebruiker
de artistieke of commerciële kwaliteit van de gerealiseerde producties
schade als gevolg van onjuist gebruik van het materiaal
schade aan het materiaal veroorzaakt door andere Gebruikers
een belemmering als gevolg van overmacht

10. Intellectuele eigendom

Werken, opnames en inhoud geproduceerd door de Gebruiker in het kader van de residentie blijven de exclusieve eigendom van de Gebruiker, tenzij schriftelijk anders overeengekomen. Jardin Musical maakt geen aanspraak op exploitatierechten zonder uitdrukkelijke toestemming.

11. Persoonsgegevens

Persoonsgegevens worden verwerkt overeenkomstig de AVG en het Privacybeleid van het Platform. De Gebruiker beschikt over een recht op inzage, rectificatie en verwijdering van zijn gegevens.

12. Schorsing / beëindiging

Jardin Musical behoudt zich het recht voor om:

een account te schorsen of te beëindigen bij ernstige schending van de AV
de toegang tot diensten te blokkeren zonder vergoeding bij misbruik

13. Wijziging van de AV

Deze AV kunnen te allen tijde worden gewijzigd. De toepasselijke versie is die welke van kracht is op het moment van gebruik van de dienst.

14. Toepasselijk recht en bevoegde rechtbank

Deze AV zijn onderworpen aan Belgisch recht. Elk geschil valt onder de exclusieve bevoegdheid van de rechtbanken van Brussel, tenzij dwingende wettelijke bepalingen anders voorschrijven.

1. Purpose

These General Terms of Sale (hereinafter "GTS") define the conditions under which the Jardin Musical platform (hereinafter "the Platform") enables professional or individual users (hereinafter "the User" or "the Artist") to:

create a personal account
join the artistic residency ecosystem of Jardin Musical
purchase credits
book studio time slots
book associated services (sound engineer, video engineer, piano tuning, overnight stay, private concert, etc.)

3. Access to the Platform

Access to the Platform is reserved for persons who are:

of legal age
legally capable
holders of a valid user account
unconditionally bound by the Terms of Use and these GTS

Jardin Musical reserves the right to refuse or suspend access to any account in the event of non-compliance with the Terms of Use or these GTS.

4. Account Creation

Account creation is mandatory to access the services. The User agrees to:

provide accurate and up-to-date information
maintain the confidentiality of their credentials
assume full responsibility for actions performed from their account

5. Description of Services

The Platform enables in particular:

booking of studio time slots at Jardin Musical
booking of technical services (sound engineer, video engineer)
booking of piano tuning
booking of an overnight stay at Jardin Musical
booking of a slot for a concert or private event
access to audiovisual autonomy training
management of credits and booking history

Services are provided according to availability shown in the calendar.

6. Credit System

6.1 Principle

Services offered on the Platform are accessible via a system of pre-purchased credits. Each service corresponds to a defined number of credits, as displayed on the Platform.

6.2 Credit Purchase

Credits are purchased via the Platform at current rates. Payments are due immediately. Credits are added to the user account after payment validation.

6.3 Credit Validity

Unless otherwise stated, credits are:

non-refundable
non-exchangeable for cash
valid for a specified duration indicated at the time of purchase

7. Bookings

7.1 Conditions

Bookings are made exclusively via the Platform, subject to slot availability and a sufficient credit balance. Any confirmed booking results in immediate deduction of the corresponding credits.

7.2 Modification and Cancellation

Modification or cancellation conditions are specified at the time of booking. In the event of late cancellation or no-show, credits may be partially or fully forfeited, except in cases of duly justified force majeure.

8. User Obligations

The User agrees to:

respect the premises, equipment and facilities
use the studio in accordance with the communicated rules
respect the reserved time slots
assume liability for any damage caused by themselves or their collaborators

Repair or replacement costs may be charged in the event of damage.

9. Liability

Jardin Musical cannot be held liable for:

loss of the User's personal data
the artistic or commercial quality of productions made
damage resulting from improper use of equipment
damage to equipment caused by other Users
any impediment related to force majeure

10. Intellectual Property

Works, recordings and content produced by the User during the residency remain the exclusive property of the User, unless otherwise agreed in writing. Jardin Musical claims no exploitation rights without explicit consent.

11. Personal Data

Personal data is processed in accordance with GDPR and the Platform's Privacy Policy. The User has the right to access, rectify and delete their data.

12. Suspension / Termination

Jardin Musical reserves the right to:

suspend or terminate an account in the event of serious breach of the GTS
block access to services without compensation in the event of abusive use

13. Modification of GTS

These GTS may be modified at any time. The applicable version is the one in force at the time of use of the service.

14. Applicable Law and Jurisdiction

These GTS are subject to Belgian law. Any dispute shall fall under the exclusive jurisdiction of the Brussels courts, unless mandatory statutory provisions provide otherwise.
